Summary of the terms and conditions of sale of MASTERRIND GmbH


1. General information

The following conditions apply beyond the general business conditions for sale of breeding and commercial cattle.

2. Legal position

With bidding and registration of an animal for sale, the seller and buyer accepts these conditions.


3. Auction procedure

3.1.

AdMission of animals to an auction is finally decided by the sale committee, or by MASTERRIND GmbH if necessary after consulting a veterinarian.

3.2.

The sequence of sale is determined by the sale committee. MASTERRIND GmbH is entitled to combine numbers of the catalogue, to split and to offer for sale in another sequence for a special reason or to withdraw. MASTERRIND GmbH specifies possible determined deficiencies of animals and amendments of the auction catalogue before offering for sale. 

3.3.

The consignor is not permitted to bid on his animals, nor is he allowed to authorize another person to bid on his animals. If the consignor sells animals that were registeRed for an auction, without perMission of MASTERRIND GmbH, charges according to the schedule of fees for buyers and sellers must be paid to MASTERRIND GmbH.

3.4. 

Before offering animals for sale, deficiencies that did not lead to exclusion from the auctions are announced, as well as amendments oradditions of the catalogue.

3.5.

Animals in milk are to be milked by the consignor immediately after sale.

3.6.

The bidder, giving off the last valid bid, shall be the buyer, except if the minimum price was not reached. The buyer must sign the purchase receipt to the authorized representative of MASTERRIND immediately after successful bidding and specify name and valid address. Every bidder is bound to his bid until the next legally valid successful bid of another bidder. In case of dispute concerning the validity of the bidding price, this is to be claimed immediately. In this case offering can be taken up again and bidding be continued. The announcement of dispute concerning the validity of the successful bid, is also then permitted, if the purchase receipt has already been signed, must however be announced at the latest by the final successful bid of the last animal of the auction. The decision concerning a possible objection due to dispute of validity of the successful bid price is made by the auction committee or an authorized representative.

3.7.

Pick up Day is the Day of the auction, the buyer is committed to take over the animals. Trucking of purchased animals has to take place immediately after the end of the auction. If shipment takes place at a later point in time, the animals remain in the auction barn at costs and risk of the buyer. Only persons having a valid transpor tation receipt, are authorized to transpor t animals from the auction.

Virgin heifer 9,50 % (Including partial Insurance fee) 6,- €

Embryos 9,50 % (Including partial Insurance fee) -

Independent of the Quality agreement (see cypher 3 of the general business conditions) the following conditions of insurance are valid.

Conditions of insurance (not part of the general business conditions)

Independent of the time periods mentioned under cypher 5 of the general business conditions, the time periods of the insurance are valid. All auction animals sold nationally are obligatory insuRed against the following damages with compensation according to the table below:

Calving 90 % of the bidding price
Udder deficiencies

15 % of the bidding price in case of 3 teats only
20 % of the bidding price in case of 2 teats only

Registration data and time limits:

1. Transport insurance

The insurance cover of sold animals for damage due to transpor t ends at arrival of the buyers barn. For animals not sold, the insurance cover ends after the direct return to the Home barn and for sales abroad with loading at the auction place or the collecting point.

2. Calving insurance

All pregnant animals are insuRed against loss through death or putting down as a result of pregnancy and bir th. Insurance cover begins when leaving the Home barn. The insurance cover ends 

  • for animals sold, 10t Days after calving, for calved animals 10 Days after he auction - at 12:00 noon. Calving must take place within 12 weeks after the auction Day. Calving or damage as a result of pregnancy after this time period is not coveRed.
  • for animals not sold, when leaving the ring.


3. Udder damage insurance

Insurance cover begins after examination of the udder at the auction place and ends 10 Days after calving, for calved animals 10 Days after the auction – at 12:00 noon. Calving must take place within 12 weeks after the auction Day. 

Apart from that the sale takes place as seen, so that no liability is assumed for external visible defects.

For animals sold with veterinarian announcement, no liability is assumed for these defects and subsequent damages by the insurance company and the seller.
